Terms and conditions

By purchasing music from Portus Press you agree to the following terms and conditions of use:

Orders and dispatch

Once an order has been placed you will receive an email confirmation.  I aim to send out all printed sheet music orders and emailed PDF orders within one working day.  Free PDFs and Digital Downloads are delivered instantly upon payment.  Please refer to Delivery for methods of postage and expected delivery times.

Prices

Price on the website are listed in British Pounds Sterling (GBP).  Non-UK customers will have the total GBP amount converted to their local currency at the exchange rate offered by the card issuer during payment.

Please be aware that prices displayed on portuspress.com are subject to change without prior notice.

Tax Charges

Currently VAT on printed music in the UK is charged at 0%. Do be aware, however, that orders placed from outside the UK may attract local taxes at the point of importation.  Such charges are the responsibility of the customer.  I am not VAT registered.

Titles with restricted territories

A small number of the titles that Portus Press offers are, for copyright reasons, not available to buy in certain countries.  Works by Gershwin, for instance, are not available to customers based in the USA.  Any such restrictions are clearly flagged up in each title’s page.  Systems are in place to prevent customers from buying restricted titles.  If, however, a customer buys a restricted title that is listed as unavailable in their country I reserve the right to cancel the order.   remove the restricted pieces.

Returns and refunds

Printed sheet music

Faulty music

If your music arrived damaged or is faulty please contact me for a refund detailing the nature of the problem within 30 days of receiving your order.  The faulty goods must be returned.  Upon receipt I will supply a new copy of the music or, if requested, arrange a refund.  I will also refund the postage costs you have incurred in returning the music.

Music sent in error

Occasionally I do make mistakes when sending out printed sheet music!  Please be assured that, if I have sent you the wrong music I shall, of course, post the correct music to you immediately I am notified.  The music sent in error should be returned to me: your postage costs will be refunded.

If you change your mind

If you change your mind you are permitted to return goods within 30 days of receiving them.  If you wish to return music to me please contact me.  In these cases the customer must pay for the return postage and you must ensure that the music is properly packaged so that it returns to me in good, resellable condition.  I will then process a refund, minus any initial postage charge, within 14 days.

Digital Downloads

Orders placed for Digital Downloads cannot be cancelled once the download link has been clicked.  In ticking the box agreeing to my terms and conditions at the checkout you acknowledge that you have waived your right to a refund/cancellation of your order.   The exception to this is where you have purchased a digital download but have not clicked on the download link.  In these circumstances if you change your mind about your Digital Download purchase within 14 days of your purchase you may cancel the order and request a full refund.

Please do, therefore, ensure that you are happy to proceed before paying for your music.  Do remember that each title features a ‘Preview’ page showing a sample of the piece’s score and also short audio samples to listen to – to help you decide whether or nor to buy a particular piece.

Of course, if there is a technical problem with the digital download I will be happy to resend or reimburse you – please get in touch if you encounter a problem.

Copyright

All Portus Press titles have full copyright clearance from the relevant administrators for sale in various territories. No piece will be knowingly sold outside of its agreed territories (information regarding which is included, where applicable, in the piece’s description). Every effort is made to sell only those pieces that are legally licensed for sale in the customer’s country. Any deliberate or negligent copyright infringements by the customer are not the responsibility of Portus Press.

Copyright – digital downloads

Please think of your PDFs in the same way as you would printed music.  Both printed music and PDFs are protected by copyright law.  Re-distributing or copying your PDFs to give to others is against copyright law.  This enables me to continue to bring you new works.

You may print the music out onto paper as required, and/or use it on-screen on any electronic device, but only for your own personal use.  You may print out a part from a set to give to another member of your group but you are not permitted to print and distribute multiple copies of the same part.  In addition you may not send others (including members of your ensemble) your digital file(s) as your digital downloads are personalized to you: every page of music in a PDF will be stamped with your name.

Security

Customers have two options for payment – via Paypal or via Stripe.  In both cases the payments are processed by those platforms. This means that I do not have access to your credit card or bank account details.  Portus Press is not responsible for any problems you encounter in using Paypal or Stripe.   Both PayPal and Stripe are very secure and automatically encrypts your confidential information in transit from your computer to theirs using the Secure Sockets Layer protocol (SSL) with an encryption key length of 128 bits.

In addition, pages on this website under ‘My Account’ are also served securely (denoted by the https:// designation and the padlock symbol at the beginning of the web address).  This website uses SSL encryption to protect your confidential data (such as your name and address details).  From My Account you can view your recent orders, manage your shipping/billing address and edit your password and account details.  You are, of course,  free to change your username, password and address details at any time.  If you would like your account deleted just let me know.

Privacy

Please refer to the Privacy and Cookies page.  Portus Press never shares your details with third parties.

Performing / recording Portus Press titles

Public performances of works published by Portus Press should be notified to the relevant performing right organisation for that country – e.g. the Performing Rights Society in the UK.  It is the customer’s responsibility to check whether the owner of the venue that you are playing at using Portus Press publications has obtained a relevant license. Most weddings and family gatherings are excluded from this requirement as they are deemed to be private functions.

Please contact me if you want to make a commercial recording of a Portus Press title.
